First-ever Criminal Prosecution of a Sitting President’s Child Sparks National Interest and Legal Debate
In a landmark legal case, Hunter Biden, the son of President Joe Biden, is set to plead not guilty to charges related to false statements on a federal form during the purchase of a handgun in 2018 and alleged possession as an illegal drug user. This historic trial marks the first-ever criminal prosecution of a sitting U.S. president’s child, bringing unprecedented attention to the legal proceedings.
Last month, Hunter Biden, 53, was charged with three counts related to the firearm purchase. His defense attorney, Abbe Lowell, confirmed his intention to plead not guilty, setting the stage for a significant legal battle.
The charges stem from accusations that Hunter Biden provided false information on a federal form to acquire a Colt Cobra handgun in 2018. Additionally, he faces allegations of possessing the firearm while being an illegal drug user. An agreement to resolve these charges, along with separate tax-related charges, fell apart in July when U.S. District Judge Maryellen Noreika declined to accept it.

Under the previous agreement, Hunter Biden had agreed to plead guilty to misdemeanor tax violations and would avoid punishment on the gun charges if he refrained from possessing firearms and using illegal drugs and alcohol for two years. His legal team maintains that this agreement remains valid and accuses prosecutors of reneging on it.
Legal experts have pointed out that firearm-related charges against Biden may face constitutional challenges. A landmark Supreme Court ruling last year expanded gun rights under the Second Amendment, which protects the right to bear arms.
Hunter Biden has been a subject of intense scrutiny from Republicans, particularly former President Donald Trump, who have alleged wrongdoing related to his business activities in Ukraine and China. Despite these allegations, Hunter Biden has never held a position in the White House or on his father’s campaign. President Joe Biden has consistently maintained that he has not discussed foreign business dealings with his son and has affirmed the independence of the Justice Department in any investigation involving a member of his family.
