Uganda’s President Yoweri Museveni has recently approved a controversial bill criminalizing same-sex conduct, further oppressing the LGBTQ+ community. The Anti-Homosexuality Act of 2023 violates fundamental rights guaranteed by the Ugandan constitution and disregards international human rights agreements the country has signed.
While Uganda’s penal code already imposes life imprisonment for same-sex conduct, the new law goes even further. It introduces vague offenses such as the “promotion of homosexuality” and even includes the death penalty for acts categorized as “aggravated homosexuality.” Attempted same-sex conduct carries a prison sentence of up to 10 years. Shockingly, the law discriminates against individuals with disabilities, denying their capacity to consent to sex and exacerbating the violation of their rights.
Advocating for LGBTQ+ rights becomes dangerous under this law, with potential imprisonment of up to 20 years. This criminalization reinforces existing violence and discrimination against the community. Previous legislation, like the now-defunct 2014 Anti-Homosexuality Act, led to arbitrary arrests, police abuse, extortion, loss of employment, evictions, and limited access to healthcare services based on perceived sexual orientation or gender identity. Mass arrests at LGBTQ+ events and establishments have been conducted, accompanied by degrading anal examinations and other forms of torture.

Furthermore, the government has failed to investigate break-ins targeting organizations supporting the LGBTQ+ community. In a concerning move, the prominent rights group Sexual Minorities Uganda (SMUG) was banned for not being officially registered with the government.
President Museveni’s endorsement of this anti-homosexuality bill undermines several fundamental rights, including freedom of expression, association, privacy, equality, and non-discrimination. The Ugandan government is duty-bound to protect the rights of all individuals, including sexual minorities. Urgent action is required to create an environment that prevents violence and discrimination against the LGBTQ+ community in Uganda and beyond.
The global community must stand in solidarity with the oppressed LGBTQ+ individuals in Uganda, advocating for their rights and pushing for change. The fight for equality and justice continues as the struggle against discrimination persists in challenging environments worldwide.
