Missguided pays out for lawsuit with KKW
It’s official: Kim Kardashian West won $2.8 million in damages from fast-fashion retailer Missguided.
Kim won due to the company using her “persona and trademarks” when they sold almost complete replicas of her most famous outfits. Additionally, they furthered overstepping boundaries by repeatedly tagging her in posts of said outfits.
In addition to winning her lawsuit, the judge who awarded Kim the money in damages and lawyer feeds from Missguided ordered them to stop using any of Kim’s trademarks “in connection with the “sale, marketing, or distribution of its products.”
Unfortunately for Missguided, it wasn’t even their actions in violation of Instagram’s rules to use Kim’s persona that got them in trouble; rather, it was the fact that they never responded to Kim’s lawsuit at all. This choice is what caused them to have a loss.
It seems many of these fast fashion companies recreate famous outfits worn by celebrities like Kim Kardashian, but hopefully, this is a lesson learned for brands like Missguided, Forever 21, H&M, and more.
