Co-founder of Miramax Films and former film producer Harvey Weinstein was acquitted of one of his sexual assault charges in a Manhattan court on October 11. Out of six current charges, the case of actress Lucia Evans, who accused Weinstein of forcing her into a non-consensual physical situation, has been dropped.
The case’s prosecutor, Joan Illuzzi-Orbon, disclosed a discovered account of the events in question in a letter to the defense unsealed on the 11th. According to this account, Evans’ actions were consensual, with with the actions in question as part of a bargain with Weinstein to obtain a role in an upcoming film.
Weinstein’s defense attorney Benjamin Brafman, in light of this account, has accused Evans of committing perjury during her testimony. Brafman believes this event has, in his own words, “permanently and irreparably damaged [the case],” and seeks to use it as a justification to have all charges dropped.
According to Evan’s attorney, Carrie Goldberg, the decision to drop this charge has no bearing on Weinstein’s guilt or innocence, attributing the blame on Manhattan’s DA office for mishandling the case. Weinstein will be returning to court to continue the case on December 20th.
