Ex husband is determined to appeal the case

A court ruled in actress Sofia Vergara’s favor over a dispute with her ex, Nick Loeb, over the fate of their frozen embryos. Loeb’s most recent lawsuit was thrown out of Louisiana courts on the grounds it was legally shoddy.

But Loeb said he’ll continue to appeal the case. Loeb wants to preserve the frozen embryos; Vergara wants them destroyed.

“We will be appealing the court’s decision. The embryos are human beings with every right to their lives and every right to be born,” Loeb’s lawyers said.

Loeb has based his case on pro-life arguments, saying that unborn embryos are humans with a right to life. He has compared his lawsuits against Vergara to the battle to end slavery.

“Under these simple definitions, a human embryo, if believed to be a human being and alive, (which is our contention) would be considered a slave and the parents would be the owners of the slave, particularly in states where they are considered property,” Loeb wrote in a previous lawsuit.

Other courts have ruled against Vergara and ordered the “Modern Family” star to pay her ex-husband $80,000 in legal fees and damages. Vergara says that the relationship is over and the frozen embryos will never be brought to term.
